Introduction

The Red Code, a significant innovation for gender violence, is a regulatory advancement introduced by Bill No. 23/2023. It aims to provide victims of violence with enhanced protection and safeguards. The reform seeks to expedite the implementation of precautionary measures against offenders, ensuring swift judicial action. Additionally, it strengthens the role of warnings issued by the Police Chief by introducing ex officio prosecution for repeat offenders, eliminating the need for victims to initiate proceedings.

Preventive innovation for gender violence, such as special surveillance with the use of an electronic bracelet, will now also apply to individuals under investigation for crimes like domestic violence, sexual violence, assault, attempted murder, and other gender-based violence offenses outlined in the Penal Code, even if the individual has no prior criminal record.

Additionally, penalties have been made more severe for those subject to precautionary measures who violate restrictions, such as approaching the victim or leaving the family home. In such cases, the offender will be caught in the act and arrested by the responsible authorities.

Conclusion

Another key innovation is the specialized training of prosecuting authorities and police forces on issues of gender-based violence. This will include conducting investigative activities in such cases to ensure victims receive adequate support and protection.

Over the years, numerous initiatives have been introduced to assist victims, and several legislative proposals and bills have helped strengthen the regulatory framework to provide greater safeguards for vulnerable individuals and their families. However, achieving effective deterrence remains an ongoing challenge, with significant progress still needed.

Looking ahead, the success of these measures will depend not only on their implementation but also on continued efforts to raise awareness and foster a cultural shift in addressing gender-based violence. Collaborative initiatives between institutions, communities, and support organizations will be essential in ensuring these protections are effective and in building a society where such violence is actively prevented and unequivocally condemned.
